1. Warranty Eligibility

This Limited Warranty applies to genuine MAX Faucets® products that:

  • Were purchased from MAX Faucets® or an authorized MAX Faucets® retailer;
  • Were installed within Canada or the United States;
  • Were installed, used, and maintained according to the applicable product instructions; and
  • Remain at the original installation location.

This warranty is provided only to the original purchaser and is not transferable.

Warranty coverage begins on the original date of purchase.

Proof of purchase may be required. If proof of purchase is unavailable, MAX Faucets® may use the product’s manufacturing date, order records, or other available information to determine warranty eligibility.

2. Meaning of Lifetime Coverage

Under this warranty, “lifetime” means for as long as the original residential purchaser owns the residence where the product was originally installed and the product remains installed at that location.

Lifetime coverage does not mean the lifetime of the purchaser, the building, or any subsequent owner.

Lifetime coverage ends if:

  • The product is removed from its original installation location;
  • The product is transferred to another owner;
  • The original purchaser no longer owns the residence; or
  • The product is used in an application that does not qualify for primary residential coverage.

3. Primary Residential Coverage

Primary residential coverage applies when the product is installed in a residence owned and occupied by the original purchaser as their primary residence.

Faucet Body and Shower Valve Body

The faucet body and shower valve body are covered by a Lifetime Limited Warranty against defects in materials and workmanship under normal residential use.

Ceramic Cartridge

The original faucet or shower valve ceramic cartridge is covered by a Lifetime Limited Warranty against defects in materials and workmanship under normal residential use.

If a covered cartridge defect causes leaking, dripping, or malfunction, MAX Faucets® will provide a replacement cartridge without charge for the cartridge itself.

Other Mechanical and Operating Parts

Other mechanical and operating parts are covered for five years from the original date of purchase against defects in materials and workmanship.

Eligible components may include:

  • Handles;
  • Diverters;
  • Showerheads;
  • Handheld showerheads;
  • Body jets;
  • Spouts;
  • Pull-down and pull-out sprayers;
  • Slide bars;
  • Supply hoses; and
  • Other non-electronic operating components.

Normal wear, deterioration, cleaning, adjustment, and routine maintenance are not considered manufacturing defects.

Electronic Components

Electronic components are covered for two years from the original date of purchase under normal residential use.

Batteries are not covered.

Factory-Applied Finish

Factory-applied finishes are covered for 10 years from the original date of purchase under the terms stated in Section 5.

4. Coverage for Other Applications

Coverage is determined by how and where the product is installed.

Rental and Multi-Family Residential Use

Products installed in rental homes, rental condominiums, apartments, duplexes, townhomes, and other multi-family residential properties receive the following coverage:

  • Faucet and shower valve body: 10 years;
  • Ceramic cartridge: 10 years;
  • Other mechanical and operating parts: 5 years;
  • Electronic components: 2 years; and
  • Factory-applied finish: 5 years.

An owner-occupied condominium used as the original purchaser’s primary residence may qualify for the primary residential coverage described in Section 3.

Commercial Applications

Products installed in offices, retail locations, restaurants, salons, commercial buildings, and similar commercial environments receive the following coverage:

  • Faucet and shower valve body: 5 years;
  • Ceramic cartridge: 5 years;
  • Other mechanical and operating parts: 5 years;
  • Electronic components: 1 year; and
  • Factory-applied finish: 5 years.

High-Use and Institutional Applications

Products installed in hotels, airports, hospitals, clinics, schools, public facilities, industrial facilities, and other institutional or high-use environments receive the following coverage:

  • Faucet and shower valve body: 2 years;
  • Ceramic cartridge: 2 years;
  • Other mechanical and operating parts: 2 years;
  • Electronic components: 1 year; and
  • Factory-applied finish: 2 years.

If more than one category could reasonably apply, the category that most accurately reflects the product’s actual installation and use will determine the applicable coverage period.

5. Factory-Applied Finish Warranty

MAX Faucets® warrants that its factory-applied finishes will be free from manufacturing defects during the applicable coverage period.

Covered finishes include, but are not limited to:

  • Matte black;
  • Brushed gold;
  • Shiny gold;
  • Polished chrome;
  • Brushed nickel; and
  • Other factory-applied MAX Faucets® finishes.

Covered manufacturing defects may include:

  • Peeling;
  • Flaking;
  • Corrosion caused by a defect in the finish application; and
  • Other confirmed defects in the original factory-applied finish.

This warranty does not guarantee that a finish will remain completely unchanged over time. Minor changes resulting from normal use, environmental exposure, water conditions, or natural aging are not considered manufacturing defects.

Finish Care Requirements

To maintain finish warranty coverage, the product must be cleaned using:

  • A soft cloth;
  • Warm water; and
  • Mild, non-abrasive soap when necessary.

The finish warranty does not cover damage resulting from:

  • Abrasive pads, scrub brushes, steel wool, or abrasive cleaning tools;
  • Cleaners containing bleach, ammonia, alcohol, acids, or harsh chemicals;
  • Bathroom sprays, glass cleaners, disinfectants, or harsh descaling products;
  • Improper cleaning or maintenance;
  • Scratches, dents, or impact damage;
  • Water spotting, mineral deposits, or hard-water buildup;
  • Cosmetic wear resulting from ordinary use; or
  • Damage occurring during or after installation.

MAX Faucets® may request photographs, videos, cleaning information, or the return of the affected component before approving a finish-related claim.

6. What This Warranty Covers

During the applicable coverage period, this warranty covers confirmed defects in materials or workmanship that affect the normal operation of the product under proper installation, normal use, and reasonable maintenance.

Covered defects may include:

  • Defects in the faucet body or shower valve body;
  • Defective ceramic cartridges;
  • Defective mechanical or operating components;
  • Leaking or dripping caused by a covered manufacturing defect;
  • Malfunction of a covered electronic component; and
  • Covered factory-applied finish defects.

The existence of a leak, drip, finish change, or malfunction does not automatically establish a manufacturing defect. MAX Faucets® may inspect or evaluate the product to determine the cause.

7. What Is Not Covered

This warranty does not cover:

  • Labour charges for diagnosis, installation, removal, repair, replacement, or reinstallation;
  • Plumber, contractor, technician, or other service-provider charges;
  • Shipping, transportation, postage, customs, brokerage, or travel expenses associated with warranty service, except where required by applicable law;
  • Damage caused by improper installation or failure to follow installation instructions;
  • Damage caused by improper plumbing connections;
  • Installation errors that caused or contributed to the claimed failure;
  • Misuse, abuse, neglect, accidents, impact, or accidental damage;
  • Outdoor installation unless the product is specifically designated for outdoor use;
  • Damage caused by freezing temperatures;
  • Damage caused by excessive or insufficient water pressure;
  • Water hammer or pressure fluctuations;
  • Sediment, mineral buildup, hard water, corrosion, or other water-quality conditions;
  • Water-treatment chemicals or conditions beyond the reasonable control of MAX Faucets®;
  • Failure to perform reasonable cleaning or maintenance;
  • Use of abrasive cleaners, bleach, ammonia, alcohol, acids, harsh chemicals, scrub pads, steel wool, or abrasive tools;
  • Normal wear and tear resulting from ordinary use;
  • Cosmetic damage occurring during or after installation;
  • Scratches, dents, water spotting, or mineral deposits;
  • Natural aging or minor changes in finish appearance;
  • Differences in finish appearance caused by lighting, photography, screen settings, or normal production variations;
  • Products purchased from unauthorized sellers or resellers;
  • Counterfeit, altered, or incorrectly identified products;
  • Damage caused by non-MAX Faucets® replacement parts;
  • Unauthorized modifications, alterations, or repairs that caused or contributed to the claimed failure;
  • Products removed from their original installation location;
  • Products used for purposes other than their intended use; or
  • Problems that do not result from defects in materials or workmanship.

Warranty coverage will not be denied solely because an unauthorized repair or modification occurred. However, coverage may be denied when the repair, alteration, modification, or non-approved part caused or contributed to the claimed failure.

8. Maintenance and Wear Components

Certain components may require cleaning, adjustment, maintenance, or replacement during normal use.

These components may include:

  • O-rings;
  • Washers;
  • Seals;
  • Aerators;
  • Supply hoses;
  • Pull-out and pull-down hoses;
  • Check valves;
  • Diverters;
  • Filters;
  • Screens; and
  • Similar maintenance or wear components.

Normal deterioration or replacement of these components resulting from ordinary use is not considered a manufacturing defect.

If one of these components fails because of a confirmed defect in materials or workmanship during its applicable warranty period, MAX Faucets® may provide warranty coverage.

9. Warranty Remedies

If MAX Faucets® confirms that a defect is covered by this warranty, MAX Faucets® will, at its reasonable discretion:

  • Repair the defective component;
  • Provide a replacement component;
  • Provide a comparable replacement product; or
  • If repair or replacement is not reasonably available, provide another remedy permitted by applicable law, which may include a refund of the original purchase price.

The approved replacement part or product will be provided without charge for the part or product itself.

Unless otherwise agreed by MAX Faucets® or required by applicable law, the customer is responsible for shipping, transportation, labour, installation, removal, reinstallation, diagnosis, and service expenses.

If the original product or component has been discontinued, the replacement may differ in colour, finish, dimensions, design, features, or specifications. MAX Faucets® will make reasonable efforts to provide a functionally comparable replacement.

A replacement part or product provided under this warranty does not extend, renew, or restart the original coverage period. The replacement remains covered for the balance of the original applicable warranty period.

10. Inspection and Return Requirements

MAX Faucets® reserves the right to evaluate each warranty claim according to its reasonable inspection and testing procedures.

Before approving a claim, MAX Faucets® may request:

  • Photographs or videos;
  • Product and model identification;
  • Proof of purchase;
  • Installation information;
  • Water-pressure information;
  • Cleaning and maintenance information;
  • Inspection by a qualified professional;
  • Return of the defective component; or
  • Return of the complete product when reasonably necessary.

Customers should not dispose of an allegedly defective product or component until MAX Faucets® confirms that it is no longer required for evaluation.

If a product or component must be returned, MAX Faucets® will provide return instructions and advise the customer of the shipping responsibilities before it is sent.

Return shipping and transportation expenses may be the customer’s responsibility unless MAX Faucets® agrees otherwise or applicable law requires MAX Faucets® to pay those expenses.

Products returned without authorization may not be accepted or reimbursed.

11. How to Request Warranty Service

To request warranty service, contact MAX Faucets® and provide:

  • Product model number, if available;
  • Original date of purchase;
  • Date of installation;
  • Full name on the order;
  • Order number, if available;
  • Proof of purchase, such as a receipt or order confirmation;
  • Installation address;
  • Detailed description of the problem; and
  • Clear photographs or videos showing the problem when requested.

Warranty claims should be submitted within a reasonable period after the problem is discovered.

Submitting a warranty claim does not automatically confirm coverage. Coverage will be determined after MAX Faucets® evaluates the available information and confirms that the problem is covered by this warranty.

MAX Faucets® will make reasonable efforts to review complete warranty claims promptly. Review times may vary depending on the information, inspection, testing, or product return required.

Important Safety Notice

If a product is leaking or appears unsafe, stop using it, shut off the water supply when safe to do so, and contact MAX Faucets® or a qualified plumbing professional.

Continued use of a visibly damaged, leaking, or unsafe product may cause additional damage.

12. Consumer Rights and Legal Limitations

This Limited Warranty provides specific contractual rights in addition to any rights or remedies available under applicable consumer protection laws.

Nothing in this warranty is intended to exclude, restrict, modify, or replace any right, remedy, warranty, condition, or liability that cannot lawfully be excluded or limited under the laws of the applicable province, territory, or state.

If any provision of this warranty conflicts with applicable law, the applicable law will prevail. The remaining provisions will continue to apply to the fullest extent permitted by law.

Subject to applicable law, MAX Faucets®’ obligations under this Limited Warranty are limited to the remedies described in Section 9.

To the maximum extent permitted by applicable law, MAX Faucets® will not be responsible under this Limited Warranty for indirect, incidental, special, or consequential losses, including loss of use, loss of time, inconvenience, or expenses not expressly covered by this warranty.

To the maximum extent permitted by applicable law, MAX Faucets®’ total liability under this Limited Warranty will not exceed the original purchase price of the affected product.

Nothing in this warranty excludes or limits liability, rights, or remedies where such an exclusion or limitation is prohibited by applicable law.

Some provinces, territories, and states do not permit certain warranty or damage limitations. Therefore, some limitations contained in this warranty may not apply to every purchaser.

Severability

If any provision of this warranty is found to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in full force and effect.

Delays Beyond Reasonable Control

MAX Faucets® will not be responsible for reasonable delays in providing warranty service caused by circumstances beyond its reasonable control, including natural disasters, transportation interruptions, labour disruptions, governmental actions, pandemics, customs delays, or supply-chain interruptions.

A delay caused by circumstances beyond MAX Faucets®’ reasonable control does not cancel an approved warranty obligation. MAX Faucets® will make reasonable efforts to complete the approved warranty service when circumstances permit.
